JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 12-04-2019 The appellant seeks pre-arrest bail in connection with Taraiya P.S. Case No. 270 of 2018, registered for offences punishable under Sections 341, 324, 323, 307, 504/34 of the Indian Penal Code and Section 3(i)(r), 3(2)(va) of SC/ST Act. Allegation against the appellant and other accused persons is that they have abused the informant by taking caste name and further allegation is that he along with others assaulted him by knife causing injury to him. Submission of learned counsel for the appellant is that injury is simple in nature and the allegation is false and concocted.
Patna High Court CR. APP (SJ) No.943 of 2019 dt.12-04-2019 2/2 Heard learned Special P.P. as well as learned counsel for the informant, they have opposed the prayer for anticipatory bail of the appellant on the ground that four injuries were found on the person of the informant and that supports that allegation. Having heard both sides, considering the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the appellant, rather he should surrender and make prayer for regular bail, which will be considered on the basis of materials available on record. Accordingly, this appeal is dismissed.
