JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 10-06-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Garhpura P.S. Case No. 15 of 2018 registered for the offences punishable under Sections 307, 504, 506, 427, 34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3⁄4 of Explosive Substance Act.

Prosecution case, as loged by the informant, is that six miscreants, in two motorcycles, came and exploded a bomb near the farm house and also damaged his four wheeler. The entire family of the informant are in a state of shock. Learned counsel for the petitioner submits that he is innocent, not named in the first information report and his name surfaced on the confessional statement of the co-accused.

No.19071 of 2020(2) dt.10-06-2020 2/2 Learned counsel for the petitioner further submits that the charge sheet has been submitted and there is no any allegation to tamper with the evidence. He further submits that similarly situated co-accused have been granted bail by this Co-ordinate Bench of this Court passed in Cr. Misc. Nos.25737 of 2019, 34982 of 2019, 41636 of 2019 and 80851 of 2019. Learned A.P.P. for the State has opposed the prayer. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai in connection with Garhpura P.S. Case No.15 of 2018.
