Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under Sections 25 (1b)a/26/35 of the Arms Act. As per the prosecution case, on seeing the police party a miscreant started fleeing away but he was apprehended by the police. On being asked, the apprehended miscreant disclosed his name as Pappu Paswan and a country-made loaded pistol and a

Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is accused in one more criminal case as stated at para 3 of the bail petition. The petitioner is in custody since 18.12.2020. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances as well as the period of custody of the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Vaishali at Hajipur, in connection with Industrial Area P.S. Case No. 202 of 2020.

The application stands allowed.
