JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 379 of the Indian Penal Code.

On the Herohonda motorcycle of the informant being stolen the FIR was lodged against unknown. Subsequently, accused Brajesh Kumar and Mithilesh Kumar were arrested in Dariyapur P.S. Case No. 263 of 2014 when the theft motorcycle of the informant and other articles were recovered. The apprehended accused suggested the name of the petitioner in the above mentioned case, thereafter the requisition was filed in the present case against the petitioner also.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.22380 of 2015 (2) dt.06-07-2015 2/2 that the petitioner has been made accused only on the basis of confession of accused Brajesh Kumar and Mithilesh Kumar. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Dariyapur P.S. Case No. 262 of 2014 pending in the court of learned CJM, Saran at Chapra.

This application is disposed of with the aforesaid observation/direction.
