2. The petitioner seeks bail in a case registered for the offence punishable under Sections-363, 366(A)/34 of the Indian Penal Code and Section-8/12 of POCSO Act.
3. It is alleged that the informant's minor daughter was kidnapped by the petitioner along with other accused persons.
4. It has been submitted on behalf of the petitioner that the victim has not supported the occurrence. Learned counsel for the petitioner has further submitted that the parties have compromised the case and a compromise petition duly signed by the parties has been filed to this effect in the court
Patna High Court CR. MISC. No.20876 of 2024(3) dt.01-07-2024 2/2 below. It has also been submitted that the petitioner is under incarceration since 25-01-2024. The petitioner is a man of clean antecedent.
5. Learned APP has opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI (Special Judge, POCSO), Banka in connection with Dhankund P.S. Case No. 113 of 2023 with condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court. (Nawneet Kumar Pandey, J) A.K.V.//- U T
