2. The petitioner is in custody in a case registered for the offence punishable under Sections 395 and 412 of the Indian Penal Code.

3. As per allegation in the FIR, it is a case of kidnapping of the two minor daughters of the informant by the petitioner and other co-accused persons.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that two girls of same village could abducted by the two persons by a single vehicle and the said vehicle allegedly used in the alleged occurrence which does not belongs to this

Patna High Court CR. MISC. No.16760 of 2025(3) dt.14-05-2025 2/3 petitioner. Petitioner has got no criminal antecedent as stated in para-3 of the petition and he is in custody since 08.12.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. On perusal of the first information report, case diary, statement of the victim girl recorded under Section 164 of the Cr.P.C. and impugned order dated 27.01.2025, it appears that victim herself stated that she voluntarily went away with the petitioner and she lives with the petitioner since last one year and when her family members got to know about her love affairs with the petitioner, they insisted and forced the victim to get marry with other person and after that she fled away with the petitioner to Nawada and from Nawada to Patna and after that went to Kolkata and finally settled in Malda with the petitioner and also stayed in Malda station and she further stated that the petitioner is my husband and now she wants to go back and settle with the petitioner, so I am inclined to grant regular bail to the petitioner.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ajay Kumar, Judicial Magistrate, Ist Class,
