This application for grant of anticipatory bail arises out of Barbigha P.S. Case No. 67 of 2016, disclosing offences under Sections 272, 273 of the Indian Penal Code and under Section 47(a) of the Excise Act.

Upon an information that two persons died after consuming the illicit country made liquor, the police raided the basement of the house of the petitioner. From the house of the petitioner, police recovered two dead bodies and a Jerkin containing 30 liters of country made liquor.

Considering the gravity of the offence, I am not inclined to grant the petitioner the privilege of anticipatory bail. This application is rejected.

Petitioner is directed to surrender before the court below

within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
