The petitioner apprehends his arrest in Suppi P.S. Case No.254 of 2019 registered under Sections 414, 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

The informant after having received information came to the bank of Bagmati river of village Rampurkanth and saw four persons putting some bags under sand but seeing the police party, all four persons managed to flee away. Local Chowkidar is said to have identified them. On search, 811.5 litres of Nepali liquor was recovered from the bags.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner.

Patna High Court CR. MISC. No.14690 of 2020(2) dt.04-09-2020 2/2 Two persons, namely, Jitu Sahani and Dahaur Paswan have been granted anticipatory bail by a coordinate bench of this court. The case of the petitioner stands on same footing. Having considered the facts that similarly situated two accused persons have already been granted anticipatory bail by a coordinate bench of this court, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II-cum-Special Judge, Excise Act, Sitamarhi in connection with Suppi P.S. Case No.254 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
