Petitioner, already in custody, seeks bail in connection with Tikkapatti PS Case No.15 of 2017, registered under Sections 341, 323, 326, 307 and 504 of the Indian Penal Code. Allegation in brief is that the petitioner, husband of the informant, who happens to be the second wife, asked to leave the house when she refused then he stabbed her several times.

Submission is that the petitioner after promise brought back his first wife who had earlier lodged a case under Section 498A of the Indian Penal Code then the informant, the second wife, herself inflicted injury.

Having considered the specific accusation and four

No.30840 of 2018(2) dt.17-05-2018 2/2 incised wounds on her part of the body including the vital part, presently the prayer of bail of the petitioner is rejected in connection with Tikkapatti P.S. Case No.15 of 2017, giving rise to S.T. No.109 of 2018, pending in the court of learned 1st Assistant Sessions Judge, Purnia.

However, the trial court is directed to expedite the trial and preferably conclude the same within nine months. If the trial does not conclude within the aforesaid period, the petitioner may renew his prayer of bail.
