The petitioner has prayed for bail in a case registered for the offence punishable under sections 365, 363, 120(B), 304, 313, 201 of the Indian Penal Code.

As per allegation in the FIR, the petitioner in connivance with others accused persons are alleged to have abducted the wife of the informant and her dead body was recovered after three days.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not named in the FIR. No one is the eye witness. His name appeared in this case on the basis of confessional statement of Soni Devi, who has already been enlarged on bail vide order dated

Patna High Court CR. MISC. No.16570 of 2023(3) dt.19-05-2023 2/2 5.5.2023 passed in Cr. Misc. No. 11183 of 2023 by a different co-ordinate Bench of this Corut. During investigation, nothing has come against the petitioner to show his complicity in the alleged occurrence. Petitioner has no criminal antecedent and he is languishing in judicial custody since 9.10.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Jude, 1st Khagaria in connection with Khagaria (Chitraguptnagar) P.S.
