JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-07-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners, who are three in number, are apprehending arrest in connection with Ballia P.S. Case No. 307 of 2019 for offences under Sections 420, 406, 467, 468, 120(B) 471 and 34 of the Indian Penal Code.
Learned counsel for the petitioners would submit that petitioner nos. 1 and 3 have no criminal antecedents and petitioner no. 2 has been made accused by the same informant in other case. The allegation against the petitioners is that they are only witnesses to the sale deed and the sale deed was executed in furtherance of transfer of the land.

No.17626 of 2020(2) dt.13-07-2020 2/2 Considering the fact that the petitioners are only witnesses to the sale deed, the Court is inclined to grant bail to them subject to the condition that the petitioners have to deposit Rs.50,000/- in cash. On depositing the amount of Rs.50,000/-, petitioners, above-named, in the event of arrest or surrender within one month from today, shall be released on bail on furnishing bail bond of Rs.50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 307 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Deposit of Rs.50,000/- (Rupees fifty thousand) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
