The petitioner seeks anticipatory bail in connection with Chanan P.S. Case No. 108 of 2018 for the offence alleged under Sections 323, 147, 366A and 34 of the Indian Penal Code. The accusation is of kidnapping of minor niece of the informant by five persons, including the petitioner, for the purpose of marriage.
Learned counsel appearing for the petitioner submits that in fact there was love affairs between co-accused, Sonu Khan, and niece of the informant, but, with ulterior motive, four others, who have no connection with Sonu Khan, have been implicated in this case. Further submission is that in paragraphs 14 and 15 of the case diary Dhobi Paswan and Baijnath Yadav, who are co-villagers, have stated that there was love affairs
Patna High Court CR. MISC. No.14770 of 2019(4) dt.25-06-2019 2/2 between the niece of the informant and Sonu Khan and niece of informant has left the house with Sonu Khan. The petitioner has no criminal antecedent.
The learned counsel for the State opposes the prayer for anticipatory bail.
In the facts and circumstances and materials on record, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Chanan P.S. Case No. 108 of 2018 shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st, Lakhisarai, subject to the conditions as laid down under Section 438(2) Criminal Procedure.
