JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376, 504/34 of the Indian Penal Code and 4 of the Protection of Children from Sexual Offences Act, 2012 Prosecution case is that father of the petitioner Md. Taiyab used to ravish the informant one year prior to lodging of the case. It is also alleged that on 10.09.2015 the informant was taken to a field by Md. Taiyab and was ravished. It is alleged against the petitioner that the petitioner threaten the informant not to lodge any case.

It is submitted by learned counsel for the petitioner that the petitioner has been roped in the present case simple because he happens to the son of the main accused Md. Taiyab. A statement

Patna High Court Cr.Misc. No.18668 of 2016 (3) dt.05-05-2016 2/2 has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessionis Judge, Saharsa in connection with Saharsa Mahila P.S. Case No.59/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
