1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 325, 307, 379, 504, 506 and 34 of the Indian Penal Code.

3. The informant alleges that he solemnized marriage of his daughter with Md. Aurangjeb thereafter she was being tortured for non-fulfillment of dowry demand, it is next alleged that on 19.09.2019, twelve named accused persons including the petitioner came variously armed and assaulted the informant along with his other family

Patna High Court CR. MISC. No.25013 of 2023(2) dt.19-07-2023 2/3 members causing injury on head, leg and other body parts of the informant and even his wife sustained injury on her hand and Nasrin Khatoon also suffered fracture of hand.

4. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that neither the petitioner is related to the informant nor to the family of the husband of his daughter, rather is a covillager. It is next submitted that why the petitioner would have indulged in an occurrence with which he has no concern, it is also submitted that there is no specific allegation of assault against the petitioner.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner abovenamed, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial
