Petitioner, already in custody, seeks bail in connection with Jagdishpur (Goradih) P.S. Case No.99 of 2017, registered under Sections 25(1-b)a/26 of the Arms Act.

Allegation is that a country made pistol with nine cartridges was recovered from possession of the petitioner. Submission is that the seizure was made, seizure list was prepared and thereafter police case number was inserted and there is no recovery of arms from possession of the petitioner. However, there is specific allegation that there is recovery of a country made pistol with nine cartridges from possession of the petitioner, so at this stage, the prayer of bail of

Patna High Court Cr.Misc. No.43363 of 2017 (2) dt.20-09-2017 the petitioner stands rejected in connection with Jagdishpur (Goradih) P.S. Case No.99 of 2017, pending in the court of learned C.J.M., Bhagalpur. However, the petitioner may renew his prayer for bail after framing of charge.
