2. Heard Mr. Dharmendra Kumar Singh, learned counsel for the petitioner and Mr. Prashant Pratap, learned GP-2, for the State.

3. The present writ application has been filed seeking directions for payment of the retiral dues of the petitioner, who superannuated on 31.12.2020, as Urdu Typist, from the office of Block Development Officer, Fatehpur, Gaya.

4. Learned counsel appearing on behalf of the petitioner fairly submits that during the pendency of the present application, the substantial grievance of the petitioner has been redressed and almost all the retiral outstanding dues of the petitioner has been

Patna High Court CWJC No.8270 of 2021 dt.04-11-2022 2/2 paid. However, he submits that vide letter no. 7531 dated 09.11.2021, the Government has enhanced the rate of dearness allowance upon the gratuity and the leave encashment as well.

In view of the submissions made on behalf of the learned counsel for the petitioner, the present writ application is disposed of with a liberty to the petitioner to file a representation before the respondent no.3 raising his claim with regard to nonpayment of enhanced dearness allowance over the gratuity and leave encashment.

6. It is made clear that if such representation is filed by the petitioner within a period of four weeks from today, the concerned respondent (Block Development Officer, Fatehpur, Gaya) shall dispose of the same by a reasoned and speaking order and if the claim of the petitioner found favour, necessary consequential order would be passed within a further period of eight weeks.
