The petitioner filed this petition for modification of the order dated 09.12.2015 passed in Cr. Misc. No. 43866 of 2015, by which the petitioner was granted anticipatory bail on undertaking that he would deposit 20% of Rs. 47,25,129/- but the petitioner deposited only Rs. 5,00,000/- and Rs. 4,45,025/- is still lying due against the petitioner.
Learned counsel for the petitioner submits that financial condition of the petitioner is very poor as he sustained loss. It appears that on his undertaking that the petitioner would deposit 20% of the aforesaid amount within four months from the date of receipt of the order the anticipatory bail was
Patna High Court Cr.Misc. No.17856 of 2016 (2) dt.07-09-2016 2/2 granted to him but more than eight months have elapsed and the petitioner did not deposit the remaining amount Rs. 4,45,025/-. The reason stated in the modification petition does not appear to be satisfactory. Accordingly, the modification petition is dismissed.
