This application has been filed for quashing of the order dated 12.12.2022 passed by Judicial Magistrate, First Class, Patna Sadar by which cognizance has been taken against the petitioner in Complaint Case No. 9288 (C) of 2022 registered for the offence u/s 420 of the Indian Penal Code. 3.

As per prosecution case, complainant has given Rs. Eight lakh Ninety Seven Thousand to the petitioner for purchasing half katha of land. It is further alleged that for the purpose of registering the land in his name accused came from Pune and demanded rest of the money amounting to Rs. One

Patna High Court CR. MISC. No.16071 of 2023(5) dt.20-08-2024 2/2 lakh three thousand. After receiving the rest amount accusedpetitioner did not register the land in his name and returned to Pune with intention to do forgery with him, this complaint case has been filed by the complainant.

The parties have settled their dispute. The learned counsel for the petitioner has handed over a demand draft of Rs. 9 Lakhs and Rs. 1 lakh to the learned counsel for the opposite party no. 2 in the Court.

Considering the submissions of learned counsel for the petitioner and Mrs. Shama Sinha, learned counsel for the opposite party no. 2, this application is allowed. 6.

The order dated 12.12.2022 by which cognizance has been taken against the petitioner in Complaint Case No. 9288 (C) of 2022 is hereby quashed with respect to the petitioner only.
