06-03-2020 Heard learned counsel for the parties.
The petitioners apprehend their arrest in Kumarkhand P.S. Case No. 228 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per F.I.R., due to land dispute between the parties, scuffle took place between them, as a result of which, the informant side sustained some injury.
It is submitted on behalf of petitioners that there is general and omnibus allegation against the petitioners and other
Patna High Court CR. MISC. No.13758 of 2020(2) dt.06-03-2020 2/2 co-accused. It is further submitted that as per injury report (Annexure 2 series), the injury caused to the informant side has been found to be simple in nature by the doctor. No case under Section 307 of the Indian Penal Code is made out against the petitioners. Petitioners have no criminal antecedent. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of their arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Kumarkhand P.S. Case No. 228 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
