Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defect(s) as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in connection with Balia P.S. Case No. 186 of 2019 in a case registered for the offences punishable under Sections 326 and 307/34 of the Indian Penal Code pending in the Court of CJM, Begusarai. It is a case of assault and shot fire upon the informant by the petitioner and other accused persons. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He
Patna High Court CR. MISC. No.26355 of 2021(2) dt.28-01-2022 2/2 further submits that there is no allegation of firing upon the informant by this petitioner.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
From perusal of the injury report (Annexure-2), it appears that there is specific allegation of firing against the petitioner upon the informant with his pistol causing him grievous injuries, as such, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is hereby rejected.
