2. The petitioner is in custody in a case registered for the offences under Section191(2), 190, 115(2), 117(2), 103(2) of the Bhartiya Nyaya Sanhita.

3. As per the prosecution case, it is alleged that petitioner along with other co-accused abused and assaulted the informant and his family members.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that petitioner has not participated in the present case, while the name of the petitioner came only because he is the family member of the co-accused persons. He next submits that it is alleged in the prosecution case that during the said occurrence one lady, namely, Sampat Devi was got injured and her hand has been broken but no injury has been shown by the

Patna High Court CR. MISC. No.16139 of 2025(3) dt.14-05-2025 2/2 informant's side which shows the injury is true. He next submits that there is general and omnibus allegation against the petitioner. He is in custody since 09.11.2024 and he has got two criminal antecedents as stated in para-3 of the bail petition.

5. However, learned APP for the State vehemently opposes the prayer for bail of the petitioner.

6. On perusal of the FIR, case diary and impugned order dated 13.02.2025, it appears no injury has been shown by the injured, namely, Sampat Devi as well as that fact that there is general and omnibus allegation against that petitioner. So, considering all facts and circumstances of the case and submission of learned counsel for the petitioner, let the above named petitioner be released on bail, on his furnishing bail bonds of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class in connection with Noorsarai P.S.
