JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420,467,468,471/120B of the Indian Penal Code.

It is alleged that the petitioner obtained appointment on the post of Panchayat teacher, on the basis of forged educational certificates.

Learned counsel for the petitioner submits that without proper verification and enquiry, petitioner's certificates have been declared to be forged and fabricated. Moreover, as soon as the petitioner got knowledge that her certificates are not genuine, she submitted his resignation on 5.12.2022 which has been duly accepted by the Panchayat Sachiv (annexure 3 to the supplementary affidavit).

In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Bhojpur at Ara in Shahpur Police Station Case No. 216 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
