====================================================== CORAM: HONOURABLE MR. JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 19-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor along with learned counsel for the complainant.

Vide order dated 05.08.2013 learned Magistrate Smt. Rashmi Prasad took cognizance of an offence punishable under Section 138 of the N.I. Act in connection with Complaint Case No.226(c) of 2013 which happens to be subject matter of instant petition. During course of hearing of instant petition as well as after appearance of the complainant/O.P. No.2 the matter was referred to High Court Mediation Centre where, the parties have agreed upon consequent thereupon, the dues have been paid by the petitioner to the complainant.

Learned counsel for the complainant has submitted

Patna High Court Cr.Misc. No.13470 of 2014 (5) dt.19-11-2016 that now no grievance subsists in the background of which, the offence being compoundable one therefore, the order of the cognizance as referred above is hereby quashed. Petition is allowed.
