JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint filed with accusation under Sections 323,452 and 376/511 of the Indian Penal Code.
It is alleged that the petitioner entered into the house of the informant and made attempt to commit rape with the complainant. Subsequently, the petitioner snatched the gold chain from the complainant.
It is submitted by the learned counsel for the petitioner that petitioner is the nephew of the complainant and wife of the petitioner filed Complaint Case No. 693C of 2012 on 25.5.2012 against the husband of the complainant under sections 354,448
Patna High Court Cr.Misc. No.22332 of 2015 (2) dt.06-07-2015 2/2 and 504 IPC, thereafter the present complaint was filed on 5.2.2013 for the occurrence of 23.2.2013. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the complaint does not reflect that the medical examination of the complainant was done.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Jamui in connection with Complaint Case no. 224 C of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
