The petitioner is languishing in judicial custody since 03.02.2017 in connection with Kadriganj P.S.Case No. 98 of 2016 for the offence alleged under Sections 304(B), 201, 34 of the Indian Penal Code.

The prosecution case, as lodged by the father of the deceased, is that his daughter was married in the year 2013 to one Ranjit Kumar and due to non fulfillment of demand of dowry, the petitioner, who is brother- in- law of the deceased along with other in-laws of the family killed his daughter and disposed of the dead body.

It has been submitted by the learned counsel for the petitioner that he is elder brother of the deceased's husband and

Patna High Court Cr.Misc. No.27827 of 2017 (3) dt.27-07-2017 2/2 has separate home and hearth. It has further been submitted that general and omnibus allegations have been levelled against all the family members and that one of the co-accused, who is also brother in law has been granted privilege of bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 25749 of 2017 on 14.06.2017.

However, learned A.P.P. for the State opposes the prayer for bail stating therein that still the dead body of the deceased was not found.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Hareram, Judicial Magistrate, 1st Class, Masaurhi, Patna in connection with Kadriganj P.S.Case No. 98 of 2016, subject to the condition that both the bailors would be close relative of the petitioner with sufficient immovable property within the jurisdiction of the concerned police station/ court, who will file an affidavit stating their relationship with the petitoner.
