The petitioner seeks bail in connection with Bhagwanpur Hat P.S. Case No. 191 of 2017 registered under Section 379 of the Indian Penal Code.

Tractor of the informant is said to have been stolen from his house and petitioner and one other accused, namely, Ramesh Manjhi were apprehended with the said tractor. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has no concern with the aforesaid occurrence of stealing the tractor. The aforesaid tractor was being driven by Ramesh Manjhi at the time of its seizure while the petitioner was sitting in the trolley of the

Patna High Court Cr.Misc. No.31194 of 2018(2) dt.21-05-2018 2/2 tractor with consent of Naresh Manjhi without knowing the tractor to be stolen one. Though, he has been convicted in the case on 22.12.2017, but remanded in 29.03.2018 and has been languishing in custody since then. Though, one more criminal case has been lodged against the petitioner, but he is on bail in the said case. The aforesaid Ramesh Manjhi has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 26.04.2018 passed in Cr. Misc. no. 21259 of 2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Siwan in connection with Bhagwanpur Hat P.S. Case No. 191 of 2017.
