The petitioner seeks bail in Sasaram (Town) Model P.S. Case No. 272 of 2017 registered under Section 379 of the Indian Penal Code.

As per the prosecution case, the motorcycle of the informant is said to have been stolen by some unknown miscreants.

It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious physical possession of the petitioner. There is nothing in the case diary indicating the complicity of the petitioner in the occurrence barring the confessional statement of co-accused. The motorcycle was recovered from the possession of one co-accused

Patna High Court Cr.Misc. No.38219 of 2017 (02) dt.11-08-2017 Dibanshu Kumar. The petitioner has been languishing in custody since 02.06.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Town) Model P.S. Case No.272 of 2017.
