JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2020 The petitioner, who is in custody since 03.02.2020, seeks bail in connection with Bochachan P. S. Case No. 130 of 2019 dated 04.04.2019 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

It appears from the prosecution case that from the house of one Shivjee Rai, 276.480 litres of liquor was recovered. Though the petitioner has been named in the F.I.R. but his accusation, it has been urged, is only because he happens to be the co-villager and sympathizer of the said Shivjee Rai.
