JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2023 Heard learned counsel for the petitioners and the State. Petitioners apprehend arrest in a case registered for the offence punishable under sections 379/498A/34 and other allied sections of the Indian Penal Code and section 4 of the Dowry Prohibition Act.

As per the prosecution case, petitioners along with other family members committed torture on the informant due to non-fulfilment of dowry demand.

Learned counsel appearing for the petitioners submits that the petitioners are mother-in-law and father-in-law of the victim. They are separate in mess and business. Allegation of torture are general and omnibus in nature against them. Thrust

Patna High Court CR. MISC. No.16717 of 2023(2) dt.16-05-2023 2/2 of allegation is against the husband of the victim who has been granted bail.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate Jehanabad in Jehanabad Mahila Police Station Case No. 32 of 2022, subject to the conditions laid down under section 438 of the Code of Criminal Procedure.
