This application is for grant of regular bail in connection with Sessions Trial No.528 of 2017 arising out of Patliputra P.S.Case No.66 of 2017, registered for the offences punishable under Sections 366A, 363/34of the Indian Penal Code. Allegation against the petitioner as per FIR is of kidnapping the minor girl of the informant.

Submission of the learned counsel for the petitioner is that the whole story of kidnapping is false and concocted as had it been so, a complaint petition must have been registered but no such complaint has been made and further there is delay of four days in lodging the FIR and furthermore the petitioner is in custody since 30.3.2017.

Patna High Court Cr.Misc. No.42374 of 2017 (2) dt.13-09-2017 2/2 Heard learned A.P.P. also, who has opposed the prayer for bail of the petitioner stating that the girl has named this petitioner.

Having heard both sides and in view of allegation of kidnapping the minor girl of the informant by the petitioner, I am not inclined to grant bail to the petitioner, however, the petitioner may renew his prayer for bail after framing of charge in this case.. With the aforesaid observation, this application is dismissed.
