In both the cases, the petitioners are seeking bail in connection with Kazi Mohammadpur P.S. Case No. 150 of 2016
Patna High Court Cr.Misc. No.44296 of 2017 (3) dt.17-01-2018 registered for offences under sections 395, 412 of the Indian Penal Code.
The bank dacoity was committed by six accused persons for an amount of Rs.47,08,631/-. From the possession of the petitioner of Cr. Misc. No. 46191 of 2017, namely, Mantu Kumar Singh, heavy amount was recovered and it could be located that it is a looted amount. With regard to the petitioner of Cr. Misc. No. 44296 of 2017, namely, Ranjit Kumar, his name surfaced on the statement of Jyoti Kumar who made a confessional statement before the police. The petitioner Ranjit Kumar is languishing in judicial custody since 10.06.2016 whereas the petitioner Mantu Kumar Singh is in custody since 8.5.2016.
Looking to the facts and circumstances of the case, let both the petitioners, namely, Ranjit Kumar and Mantu Kumar Singh, be released on bail in the 2nd week of February, 2018 on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No. 150 of 2016, subject to the condition that in both the cases, the bailors will be either the father, mother, wife or sister of each of the petitioners and both the
Patna High Court Cr.Misc. No.44296 of 2017 (3) dt.17-01-2018 petitioners will report to the Kazi Mohammadpur police station on 21st of every month till disposal of the criminal trial. In failure to report to the aforesaid local police station even on single date, the bail of the petitioner will be treated to have been cancelled and they will also not try, in any manner, to tamper the evidence. The petitioners must also remain present in the court below on day-to-day basis. If the petitioners remain absent for the two consecutive dates, the court will be at liberty to pass order of cancellation of the bail. The court below is also directed to commit the case to the court of sessions and, after its commitment, the trial court will ensure that the trial should be completed within one year from the date of commitment of the case. The Bank officials are also directed to cooperate in the disposal of the case.
