Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that informant went to Kolkata on 30.01.2015. On 02.02.2015 at 8:00 P.M he got information from his daughter Sikha Kumari that wife of the informant has been beaten to death by the petitioner and coaccused Amar Singh and Manoj Singh. The informant thereafter returned from Kolkata on 03.02.2015 when the daughter of the informant narrated the story that while she was taking the wife of the informant to the doctor, this petitioner and two others assaulted with fists, lathi and knife. Patna High Court Cr.Misc. No.22321 of 2015 (2) dt.06-07-2015 2/2 petitioner that postmortem reflects no knife injury. Moreover the postmortem was conducted on 04.02.2015 which suggests the time of death of the victim as 24 hours when admittedly the victim died on 02.02.2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Let learned Court below consider the prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Asarganj P.S. Case No. 14 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Munger.

With the observations above, the application stands disposed off.
