JUSTICE SANJAY KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Jankinagar Police Station Case No. 74 of 2017 registered for offences punishable under sections 394, 120(B) of the Indian Penal Code and 27 of the Arms Act.

The allegation is that three unknown persons came on a motor cycle without having any registration number and intercepted the son-in-law of the informant, namely, Mukesh Kumar who was travelling on a truck and looted Rs.2,00,000/- from him. The said miscreants after snatching money, shot fire on the victim and caused injury.

The learned counsel for the petitioner submits that the Driver of truck was apprehended by Police and he disclosed the

Patna High Court Cr.Misc. No.46884 of 2017 (2) dt.21-09-2017 2/2 name of this petitioner. The driver of said truck, namely, Pintu Yadav @ Pintu Kumar Yadav has been allowed bail by one of the coordinate Bench of this Court in Criminal Misc. No. 31274 of 2017 on 11.07.2017. The case of the petitioner stands on similar footing. He has not been put on T.I.P.. He is in custody since 19.04.2017, having clean antecedent and so, he also deserves to be enlarged on bail.

The learned Additional Public Prosecutor on the other hand opposed the submission.

Considering the case of the petitioner on similar footing to the case of co-accused as stated above, the prayer of bail is allowed and the petitioner- Sudam Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Purnea, in connection with Jankinagar Police Station Case No. 74 of 2017.
