The petitioner, on remand, is in custody since 04.11.2017 in connection with Nalanda P.S. Case No. 170 of 2017 for the offence registered under Sections 399 and 402 of the Indian Penal Code.

Learned counsel for the petitioner submits that only on the basis of suspicion that the petitioner was preparing to commit dacoity, he was taken into custody. It is further submitted that the petitioner had no such intention to participate any docoity rather on the basis of suspicion he has been arrested and thereafter, he has also been remanded in connection with Nalanda P.S. Case N.. 171 of 2017.

Patna High Court Cr.Misc. No.32748 of 2018 (3) dt.28-06-2018 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda, Bihar Sharif in connection with Nalanda P.S. Csse No. 170 of 2017.
