The petitioner apprehends his arrest in connection with Pachrukhi (Sarai O.P.) P.S. Case No.257 of 2021 registered under Section 30(a), 34(b), 36 and 41 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery has been made from Barkulwa Bandh. The petitioner has no concern with the seized liquor. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

Patna High Court CR. MISC. No.18083 of 2023(3) dt.19-05-2023 2/2 parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Excise Court No.I, Siwan in connection with Pachrukhi (Sarai O.P.) P.S. Case No.257 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
