JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Thawe P.S Case No. 121 of 2016 for an offence under sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b)a/26/34 of the Arms Act.
Counsel for the petitioner submits that except this petitioner all other co-accused in this case have been granted bail by different orders passed by this court. The case of the petitioner is similar to those who have been granted bail by this court and as such the petitioner deserves bail.
Having considered the submission of the learned counsel for the petitioner that Chandeshwar Bhagat @ Chandeshwar Kushwaha has been granted bail by this court in Cr.
Patna High Court Cr.Misc. No.44006 of 2017 (2) dt.19-09-2017 2/2 Misc. No. 52263 of 2016 vide order dated 11.01.2017, Golu Kumar Mishra was granted bail vide order 19.12.2016 in Cr. Misc. No. 52815 of 2016, Bunty Kumar @ Bunty Singh was granted bail vide order dated 13.2.2017 in Cr. Misc. No. 4493 of 2017, Om Prakash Manjhi @ Choudhary was granted bail vide order dated 23.2.2017 in Cr. Misc. No. 5684 of 2017, Ahmad Ali was granted bail vide order dated 16.03.2017 in Cr. Misc. No. 8745 of 2017 and Jitendra Yadav was granted bail vide order dated 19.05.2017 in Cr. Misc. No. 19344 of 2017 on the ground of parity, I am inclined to enlarge the petitioner named above on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J.-III or successor court, Gaopalganj, in S. Tr. No. 70/17 arising out of Thawe P.S. Case No. 121 of 2016 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
