JUSTICE SHIVAJI PANDEY ORAL ORDER 25-09-2020 Heard learned counsel for the petitioners and the State. In the present case, the petitioners are seeking bail in Sour Bazar P.S. Case No.466 of 2019 registered for offence punishable under Sections 147, 148, 149, 341, 323, 307, 384, 379, 504, 506 of the Indian Penal Code and later on Section 302 was added.
Allegation has been made in the FIR that co-accused including the petitioners have assaulted the father of the informant, as a result of which, he died, however, counsel for the petitioners submits that there is no specific overt act attributed against the petitioners. Patna High Court CR. MISC. No.14009 of 2020(3) dt.25-09-2020 2/2 accused Mithilesh Yadav, Bijendra Yadav, Arun Yadav and Kishore Yadav. It is urged that the petitioners are in custody since 21.12.2019 having no criminal antecedents. Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 466 of 2019.
