JUSTICE ARUN KUMAR ORAL ORDER 17-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 18.2.2018, seeks bail in Laheriasarai PS Case No. 71 of 2018 registered under Sections 420, 467, 468, 471, 120B of the IPC and Section 12(ii)(1-A)a of Passport Act.
The allegation in brief is that during police verification of the application seeking passport of Rikky Kumar Yadav it was found that he is a citizen of Nepal and applied for passport as an Indian citizen when the petitioner and other witnesses identified him. Learned Counsel for the petitioner submits that Rikky Kumar Yadav, the applicant, was living for many years in the area and on the recommendation of Ikbal Khan he identified him and this petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Ghulam Ajmeri Khan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Darbhanga in connection with Laheriasarai PS Case No. 71 of 2018.
