Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 465, 467/34 of the Indian Penal Code.
It is alleged that petitioners took Rs.
70,000/- from the informant for providing employment as Anganbari Sewika and supplied forged appointment letter. It is submitted by learned counsel for the petitioners that in fact petitioners took loan of Rs. 63,000/- from the informant for the treatment of their son and they had already paid Rs. 56,000/-. Moreover an informatory petition to that effect was filed by the petitioners on 09.06.2014 and thereafter the present F.I.R was registered on 19.06.2014. However, since the petitioners have no proof with regard to the
Patna High Court Cr.Misc. No.23981 of 2015 (2) dt.10-07-2015 2/2 payment, hence they are ready to make payment of Rs. 63,000/- through bank draft drawn in favour of the informant within a period of six months by submitting the same before learned Court below.
Considering the present stand of the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for seven months on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Shastri Nagar P.S. Case No. 345 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The provisional anticipatory bail of the petitioners will be confirmed by learned Court below on submission of draft Rs. 63,000/- by the petitioners through bank draft in favour of informant before learned Court below within a period of six months which will be released in favour of the informant on filing appropriate application to dispose of the case on the basis of settlement.
