The petitioner seeks bail in Special Case No. 47 of 2018 arising out of Patna Junction P.S. Case No. 47 of 2018 registered under Sections 273 of the Indian Penal Code and 30(a) of the Bihar Excise Amendment Act, 2016.

30.500 liters of foreign liquor is said to have been recovered from the trolley bag of the petitioner and petitioner was apprehended from platform no.3 of Patna Junction. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. Petitioner happens to be labourer. He was carrying the aforesaid bag of its owner as a labourer and seeing the police party the owner of the bag managed to escape

Patna High Court Cr.Misc. No.31376 of 2018 (02) dt.21-05-2018 2/ 2 and petitioner was apprehended. He has no knowledge of keeping the liquor in the said bag by its owner. The petitioner has no criminal antecedent and has been languishing in custody since 15.02.2018.

Considering the facts aforesaid, the above named petitioner/s is/are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 47/2018 arising out of Patna Junction P.S.
