The petitioners are in custody since 15.04.2018 in connection with Gogri P.S. Case No. 468 of 2017 for the offence registered under Sections 447, 384, 387/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the allegation against the petitioners is that they threatened the informant to drive away, putting his rifle on his chest. However, it is not alleged that the petitioners had fired. It further appears that a Mutation Case is pending between the parties and, the scope of false implication cannot be ruled out as the parties are at litigating terms.

Patna High Court Cr.Misc. No.31980 of 2018 (3) dt.29-06-2018 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Gogri P.S. Case No. 468 of 2017.
