Learned A.P.P. for the State is present through video conferencing.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 148, 149, 353, 323 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, It is stated by the informant that he received information that the accused Munil Yadav along with his accomplices were beating up some persons. The informant along with other police personnel

They made an attempt to catch hold of the accused but taking benefit of darkness, the accused escaped. One of the accused was arrested who disclosed his name as Nageshwar Prasad Singh.

From perusal of the material on record it transpires that the petitioner is not named in the FIR. His name transpired in course of investigation. A number of co-accused have been acquitted. The petitioner is in custody since 7.7.2021. Heard learned A.P.P. for the State.

Having heard learned A.P.P. for the State and having perused the material on record, it transpires that the FIR was registered in the year 1995. The petitioner was granted bail, however it transpires that the bail bond of the petitioner was canceled prior to commitment, on 14.2.2004. The petitioner was declared an absconder on 19.1.2012 and it was only on permanent warrant that he was arrested and taken into custody on 7.7.2021.

Thus from the facts stated herein above it transpires that the petitioner was on bail in this case and even after cancellation of bail on 14.2.2004 he continued to abscond for more than 17 years till he was arrested on 7.7.2021.
