The petitioner apprehends his arrest in connection with Laheri P.S. Case No. 18 of 2025 registered for the offences punishable under Sections 30(a) & 37 of the Bihar Prohibition and Excise Act and Section 9 of the Loudspeaker Act, 1955 and Sections 316(2), 318(2), 297 of the BNSS and Section 4 & 11 of the Bengal Public Gambling Act, 1867.

Prosecution case in brief is that 1.125 litres liquor was recovered from hotel. It is alleged that the petitioner along

Patna High Court CR. MISC. No.14713 of 2025(3) dt.04-04-2025 2/3 with other co-accused persons is involved in drinking and partying in hotel at loud music.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. No incriminating article has been recovered from the conscious or physical possession of the petitioner. Petitioner has been roped in this case on the basis of disclosure made by the hotel staff that he happens to be coordinator of the hotel. It is further submitted that the petitioner is not the owner of the hotel in question. Other co-accused has been granted regular bail by this Court vide order dated 25-02-2025, passed in Cr. Misc. No. 12557 of 2025.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6.

Considering the rival submissions made by the learned counsel for the parties, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the
