The petitioner seeks bail in connection with Paliganj P.S. Case No. 415 of 2019, registered under Sections 25(1-b)A, 26 and 35 of the Arms Act.

The accusation is that in course of checking of the vehicle, three persons were seen coming on the motorcycle, who were apprehended by the Police, who disclosed their name Ritesh Kumar, Lucky Kumar @ Butan Kumar and Vishwakarma Kumar (Petitioner). On search, Ritesh Kumar was found in possession of one loaded country made pistol, Lucky Kumar @ Butan was found in possession of two live cartridges, whereas, this petitioner was found in possession of sharp edged knife and a mobile.

No.13842 of 2020(2) dt.03-03-2020 2/2 Learned counsel for the petitioner submits that no firearm was recovered from the possession of petitioner, rather, one knife is said to be recovered from his possession. The petitioner has no criminal antecedent and he is in custody since 13.11.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Danapur in connection with Paliganj P.S. Case No. 415 of 2019.
