JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-01-2016 Petitioner being Headmaster of Primary School, Digha Araria Block, Ghora Sahan is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409, 420 of the Indian Penal Code and Section 3(1)(x) of the Sc & ST (Prevention of Atrocities) Act. The prosecution case is that petitioner used to humiliate the informant and subsequently withdrew Rs. 40,000/- without completing the construction work. It is submitted by learned counsel for the petitioner that when the petitioner was suspended and he was not giving charge then petitioner filed C.W.J.C No. 20639 of 2014 before this Court. Hence, as a retaliatory measure the present case has been lodged. It is further submitted that for the occurrence of 01.12.2014 the F.I.R was registered on

Patna High Court Cr.Misc. No.485 of 2016 (2) dt.08-01-2016 2/2 15.02.2015.

Considering the delayed lodging of the case and the writ petition being filed against the informant by the petitioner at earlier point of time, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Motihari, East Champaran in connection with SC/ST (MTI) P.S. Case No. 8 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
