1. Heard learned counsel for the petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with Amnaur P.S. Case No. 376 of 2022, dated 19.12.2022 registered for the offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
3. The main submissions advanced by petitioner's counsel are that the instant matter relates to the recovery of 20 litres and 30 litres of country-made wine and the petitioner is concerned to the recovery of 20 litres of alleged wine as according to prosecution the said wine is stated to have been recovered from his possession but petitioner has been falsely roped in the present matter and he has been languishing in jail
Patna High Court CR. MISC. No.20040 of 2023(2) dt.10-05-2023 2/2 since 20.12.2022. Further submission is that against the petitioner there are criminal antecedent of two cases out of which he has got bail in one case and in the present matter investigation has been completed against him.
4. Learned APP appearing for the State opposes the prayer for bail.

Considering the above submissions and mainly petitioner's custody period and the completion of investigation against him and the quantity of the alleged wine which is stated to have been recovered from the possession of this petitioner, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Amnaur P.S.
