JUSTICE ARUN KUMAR ORAL ORDER 21-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with S.T.No. 47 of 2018 arising out of Mojahidpur (Babarganj) P.S.Case No. 210 of 2017 registered under Sections 307, 308 and 353/34 of the Indian penal Code and Sections 25(1-b),a/26/27 and 35 of the Arms Act.

Allegation in brief is that police, on receiving information of assembling criminals, raided there and apprehended one Md. Imtiyaz but rest others escaped away and apprehended person disclosed the name of the petitioner.

Submission is that Md. Imtiyaz, who was apprehended at the spot, was admitted to bail earlier by a co-ordinate Bench of this Court vide Cr. Misc. No. 63426 of 2017 though petitioner has criminal antecedents but except disclosure of his name in

Patna High Court Cr.Misc. No.35341 of 2018(2) dt.21-06-2018 2/2 the confessional statement of Md. Imtiyaz, there is no other materials against him and has been in custody since 20.11.2017. Having considered the aforesaid facts and circumstances, the petitioner, namely , Md. Rahmat Quraishi @ Rahmat Quraishi @ Md. Rahmat, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Addl. Sessons Judge-V, Bhagalpur in connection with S.T. No. 47 of 2018 arising out of Mojahidpur (Babarganj) P.S. Case No. 210 of 2017with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
