JUSTICE MADHURESH PRASAD ORAL ORDER 21-08-2019 Counsel for the petitioner submits that the petitioner's claim for benefits on account of promotion to the post of Chief Head Warder and subsequent promotion thereafter has been agitated by way of representation before the Inspector General of Prisons, Bihar.
The representations before the IG (Prisons) as well as the Director General is contained in Annexure 4 series to the writ petition. In view of the petitioner's retirement, at best the petitioner would be entitled to benefits on account of such promotion if his claim is found admissible by the respondent authorities.
In the said circumstances, since the matter is pending consideration before the authorities, the writ petition is disposed
Patna High Court CWJC No.8616 of 2015(2) dt.21-08-2019 2/2 of with a direction to respondent No. 2 to take a final decision on petitioner's representation by a reasoned and speaking order in accordance with law within a period of three months from the date of receipt/production of a copy of this order. If any dues are found admissible, the same are also to be paid within the aforesaid period.
The writ application stands disposed of with the aforesaid direction.
