JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Barhat P.S. Case No. 57 of 2018, registered for the offences punishable under Sections 408, 409, 420, 467, 468 and 34 of the Indian Penal Code.
Allegation against the petitioner is that he in collusion with others has given the benefit under Pradhan Mantri Awas Yojna to five persons of the same family by committing irregularity and petitioner happens to be Gramin Awas Sahayak. Submission of learned counsel for the petitioner is that as per Circular itself it is the duty of the Gramin Aawas Sahayak to supervise and examine the list and petitioner is nowhere in the selection process and he has referred paragraph 21 and other paragraphs of the FIR to show that Mukhiya has got the list approved and as such he has no hand in it.

Having heard both sides and in the facts and circumstances, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on the basis of the materials available on the record and, if possible, to be disposed of on the same day.
With the above observation, this application is disposed of.
