The petitioner seeks bail in connection with Spl. Case No. 03 of 2020, arising out of Jiyapokhar P.S. Case No. 01 of 2020, registered under Sections 8, 17(b), 18(b), 20(b)(ii) (A) of the N.D.P.S. Act, pending in the Court of learned Sessions Judge-cum-Special Judge (NDPS Act), Kishanganj. The accusation is of recovery of packets containing 582 grams opium and 24 grams Ganja from the possession of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent and he is in custody since 23.01.2020. Further submission is

Having considered the facts and circumstances of the case and recovery of huge quantity of opium, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer of the petitioner, above named, is rejected, at present. However, petitioner is at liberty to renew his prayer for bail after one year, if the trail of the petitioner is not concluded within one year. (Rajendra Kumar Mishra, J) manish/- U T
